These Terms govern your use of marvinwatch.com and its related content, features, tools, products and services (the “Services”). “MARVINWATCH,” “we,” “us” and “our” refer to the merchant operating the store. Shopify provides the commerce platform, but purchases are made directly from MARVINWATCH. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility, Accounts and Information

You must be at least the age of majority in your state or province of residence. Information you submit, including billing, payment and shipping information, must be accurate, current and complete. You are responsible for safeguarding account credentials and activity through your account and may not transfer or sell your account.

2. Marvin Products

We make reasonable efforts to describe and display each timepiece accurately, but screen settings, photography and materials may affect perceived color or appearance. Product descriptions, specifications, availability and quantities may change without notice. We may discontinue a product or limit sales by person, household, region or jurisdiction. Product purchases are also subject to the separate Return and Refund Policy and, where applicable, the 5-Year Limited Movement Warranty.

3. Orders, Acceptance and Cancellation

Submitting an order is an offer to purchase. An order is accepted only after MARVINWATCH confirms acceptance and payment is received and processed. We may accept, reject, limit, change or cancel an order, including for suspected fraud, pricing or inventory errors, resale activity or legal restrictions. We will attempt to notify you using the contact information supplied at checkout. Review orders carefully; cancellation cannot be guaranteed after preparation or dispatch begins.

4. Prices, Taxes and Payment

The price charged is the price shown when the order is placed and in the order confirmation, subject to correction of obvious errors as allowed by law. Unless stated otherwise, prices exclude taxes, shipping, customs duties and import charges. Payment methods displayed at checkout may depend on device, location, order value and provider approval. Installment products, including Afterpay or Shop Pay installments when offered, are governed by the provider’s separate eligibility and terms.

5. Shipping and Delivery

MARVINWATCH currently serves the United States, Canada and Mexico through trackable delivery. Delivery estimates are guidance, not guarantees. Remote locations, customs, carrier conditions, severe weather and promotional periods may cause delay. Risk-of-loss terms are subject to applicable consumer law; nothing in these Terms removes non-waivable rights for lost or damaged deliveries.

6. Intellectual Property

The Services—including Marvin names, trademarks, watch designs, photographs, text, graphics, video, interfaces and other content—are owned by or licensed to MARVINWATCH and protected by applicable intellectual-property laws. You receive a limited, revocable, non-transferable right to access the Services for personal, non-commercial shopping use. No content may be copied, reproduced, modified, distributed, sold, scraped or exploited without prior written permission except as permitted by law.

7. Third-Party Tools and Links

The Services may include optional third-party tools, payment services, links or embedded functions. They may be provided “as available” and governed by third-party terms. MARVINWATCH is not responsible for third-party content, services or transactions. Review the third party’s terms and privacy notice before use.

8. Relationship with Shopify

Shopify enables MARVINWATCH to provide the Services, but sales are made directly between you and MARVINWATCH. Shopify is not responsible for the products or for injury, damage or loss arising from your purchase, except to the extent responsibility cannot lawfully be excluded. Personal information processed through Shopify is addressed in our Privacy Policy and Shopify’s applicable privacy notice.

9. Reviews, Feedback and User Content

If you submit reviews, photographs, suggestions or other content, you grant MARVINWATCH a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, adapt, publish, distribute and display it for operating, improving and promoting the Services. You must own or control the necessary rights, disclose incentives, and ensure the content is accurate, lawful and does not infringe privacy, publicity, intellectual-property or other rights. We may moderate or remove content but have no obligation to do so.

10. Errors and Corrections

Information may occasionally contain errors relating to product descriptions, prices, promotions, shipping charges, transit times or availability. We may correct errors, update information or cancel affected orders, subject to applicable law. If an accepted order is cancelled after payment, the amount collected for the cancelled item will be refunded.

11. Prohibited Uses

You may not use the Services unlawfully; violate rights; submit false, abusive, defamatory or malicious content; transmit malware; interfere with security or operation; impersonate another person; collect others’ personal information; spam or phish; scrape or systematically extract store data; use automated agents to access the Services contrary to published restrictions; or resell the Services or content. We may restrict or terminate access for violations.

12. Disclaimers and Limitation of Liability

Except for express product warranties and rights that cannot be excluded by law, the Services are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. To the maximum extent permitted by law, MARVINWATCH is not liable for indirect, incidental, special, consequential or punitive loss arising from use of the Services. These limitations do not apply where prohibited, including to liability that cannot legally be limited or excluded.

13. Indemnification

To the extent permitted by law, you agree to indemnify MARVINWATCH and its affiliates, personnel and service providers against third-party claims arising from your unlawful misuse of the Services, breach of these Terms or infringement of another person’s rights.

14. Severability, Waiver and Assignment

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a business transfer or as otherwise permitted by law.

15. Governing Law and Consumer Rights

These Terms are governed by the laws applicable where MARVINWATCH is headquartered, without removing any mandatory consumer protection available where you reside. Courts with lawful jurisdiction may hear disputes. Before filing a claim, contact service@marvinwatch.com so we can attempt to resolve the issue.

16. Changes and Contact
